The Fifth Amendment of the U.S Constitution provides "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public" In the article, advises their students that they had the Fifth Amendment right to not incriminate themselves, from taken a school-mandated survey about risk behavior.
School superintendent Jack Barshingon of an Illinois high school wanted to give his students a 34 page survey on a personal question about drugs and tobacco use. He stated that his intend was to help students that needed help, the survey was suppose to help the students, it was never intended to give to the law enforcement. Parents was given the opportunity on weather they wanted their child to take the survey .
John D. a teacher at the high school told the young students that they had the 5th amendment right to not incriminate themselves. It was not his intend for them not to take the survey. He was docked a days pay. Jack took action to the school.
In the 5th amendment the students can not do anything that incriminate themselves by taken them they would be discriminating themselves also. They can't force them to say anything about them that might cause them to bring trouble to themselves
